Waiver and Release of Liability and Photo/Media Release
for those participating in activities at
Bay Area Capoeira & Jiujitsu, Nadi Jiu Jitsu, and
Capoeira Brasil San Francisco Peninsula located at
409A Old County Road, Belmont, CA 94002
(collectively "Bay Area Capoeira & Jiujitsu")
I, undersigned, for myself or as parent/guardian to child(ren) listed below, do hereby sign this Waiver and Release of Liability and Photo/Media Release to participate in activities offered by Bay Area Capoeira & Jiujitsu, whether offered at its address above or elsewhere.
I hereby assume full responsibility and liability for all damages, injuries, illnesses and losses that I/my child may sustain or incur while participating in these activities.
I realize that serious injury is commonplace in martial arts such as the one I am/my child is hereby entering and that death is a possibility. I also realize that if I/my child is injured, I/my child might be disfigured, disabled and/or rendered unable to work again. By participating in any activity offered by Bay Area Capoeira & Jiujitsu and its affiliates, I agree to and fully accept and assume liability for any and all injuries that I/my child may incur and expressly give up and waive any and all claims that I or anyone acting on my behalf through me might have against Bay Area Capoeira & Jiujitsu, Nadi Jiu Jitsu, and Capoeira Brasil San Francisco Peninsula, and their designated instructors for any injury regardless of its nature, effect or affect on me/my child as a result of participation and/or presence at classes/activities.
I authorize, and agree to hold harmless, whatever medical personnel may be present at the premise to take any action necessary, should I/my child become injured.
I represent that I/my child is in good health; that I/my child is not presently, nor will I/my child participate while ill, being treated for a contagious illness or under the influence of any drug or medication; that no one affiliated with this organization has encouraged me/my child to participate or made any representations regarding my/my child's fitness or ability to participate; that I have read and understood every provision of this Waiver and Release of Liability; and that I am legally competent to and freely enter into this Waiver and Release of Liability.
Bay Area Capoeira & Jiujitsu, Nadi Jiu Jitsu, Capoeira Brasil San Francisco Peninsula, and their designated instructors, likewise expressly reserve the right, in their sole and absolute discretion, with or without cause, to remove any participant from any classes/activities in case the participant does not follow the established rules of safety and respect other participants.
If any dispute arises out of, or is any way related to your participation in these activities, by signing this Waiver and Release Liability, you are hereby expressly waiving and giving up your right to the filing of a lawsuit in state or federal court and a trial by jury. The word "dispute" as used above refers to anything, including claims for injury (which you have already waived) that may have occurred, or you claim did not occur during these activities.
By participating in events/activities, I hereby grant Bay Area Capoeira & Jiujitsu, Nadi Jiu Jitsu, Capoeira Brasil San Francisco Peninsula and representatives the irrevocable right and permission to photograph, video record, and/or otherwise capture my image, likeness, voice, and/or appearance. I understand that these images and recordings may be used in any media format - including but not limited to print materials, social media, websites, promotional materials, and digital communications - without further notice or compensation.
I agree that all such photographs and recordings taken by or on behalf of Bay Area Capoeira & Jiujitsu, Nadi Jiu Jitsu, Capoeira Brasil San Francisco Peninsula are the property of the organization and may be edited, altered, copied, exhibited, published, or distributed by lawful purposes. I waive any right to inspect or approve the final product in which my likeness appears.
I have read and understood every provision of this Waiver and Release Liability and Photo/Media Release and I am legally competent to and freely enter into this Waiver and Release of Liability and Photo/Media Release and assume all risks.
